Terms of Service

Restricted Access: OpenIntel is available exclusively to law firms, licensed private investigators, insurance investigation firms, financial institutions, government agencies, and other authorized professional entities. All purchases require business verification and approval. Unauthorized or unethical use will result in immediate termination and may be reported to law enforcement.
This Terms of Service Agreement ("Agreement") governs access to and use of the OpenIntel platform and any related software, services, or technologies provided by Detailed In Design, LLC ("the Company," "we," "us," or "our"). By accessing, installing, or using OpenIntel, you ("User," "you," or "your") acknowledge that you have read, understood, and agree to be bound by this Agreement. If you do not agree, you must not access or use OpenIntel.
1. Purpose and Intended Use
OpenIntel is designed exclusively for lawful investigative, analytical, and intelligence-gathering purposes conducted by authorized professional entities. All use must comply with applicable federal, state, and local laws, including but not limited to:
- Fair Credit Reporting Act (FCRA)
- Gramm-Leach-Bliley Act (GLBA)
- Driver's Privacy Protection Act (DPPA)
- Right to Financial Privacy Act (RFPA)
- Electronic Communications Privacy Act (ECPA)
- All applicable state privacy regulations and licensing requirements
2. Authorized Users and Eligibility
OpenIntel is restricted to the following categories of users:
- Law firms - Attorneys and legal professionals conducting lawful investigations in connection with legal proceedings, litigation, or client representation
- Licensed private investigators - Individuals or agencies holding valid state PI licenses conducting investigations within the scope of their licensure
- Insurance investigation firms - Companies investigating insurance claims, fraud, or subrogation under applicable regulatory frameworks
- Financial institutions - Banks, credit unions, and financial services companies conducting due diligence, fraud detection, or compliance activities
- Government agencies - Federal, state, or local government entities conducting lawful investigations within their jurisdiction and authority
- Other authorized professional entities - Businesses that demonstrate a legitimate, lawful need for OSINT intelligence capabilities and pass our business verification process
2.1 Purchase Approval Requirement
All purchases of OpenIntel require prior business verification and approval by Detailed In Design, LLC. You must submit:
- Proof of business entity (business license, articles of incorporation, or equivalent)
- Description of intended use demonstrating a lawful, professional purpose
- Professional license number (for private investigators, attorneys, or other licensed professionals)
- Business website and contact information
We reserve the right to deny access to any applicant who cannot demonstrate a legitimate, ethical, and lawful basis for using the platform. Approval decisions are final and at our sole discretion.
2.2 User Accounts
Access is restricted to authorized personnel who have been issued valid credentials. Each user account is personal and non-transferable. Users are responsible for maintaining the confidentiality of their credentials and for all activities conducted under their accounts.
3. Ethical Use Requirement
All use of OpenIntel must be ethical, lawful, and within the scope of your professional authorization. Any use that violates this principle - even if technically legal - may result in immediate termination at our sole discretion.
Ethical use requires that you:
- Use the platform only for purposes directly related to your professional duties
- Obtain all legally required authorizations, consents, or court orders before conducting investigations
- Handle all information obtained through the platform with the same duty of care as attorney-client privileged information
- Report only verified, accurate information in your professional work product
- Not use the platform to gain unfair advantage, harass, intimidate, or discriminate against any individual
- Maintain complete records of your investigative activities for audit and compliance purposes
4. Prohibited Uses
You shall NOT use OpenIntel for:
- Stalking, harassment, or intimidation of any individual
- Unauthorized surveillance without proper legal authority or consent
- Discrimination based on race, ethnicity, religion, gender, sexual orientation, disability, or any protected class
- Consumer reporting without full FCRA compliance (OpenIntel is not a consumer reporting agency)
- Doxxing or publishing private information to harm or threaten individuals
- Marketing, solicitation, or spam - using data obtained through the platform for unsolicited commercial communications
- Competitive intelligence theft - accessing trade secrets or proprietary information of competitors
- Circumventing access controls - bypassing security features, API limits, or license restrictions
- Reverse engineering - decompiling, disassembling, or reverse engineering any component of the platform
- Resale or redistribution - selling, sublicensing, or sharing access, data, or intelligence obtained through the platform
- Automated scraping - using bots, scrapers, or automated tools to access the platform except through provided APIs
- Any unlawful purpose - including any activity that violates federal, state, or local law

5. Data Handling and Privacy
All data accessed, processed, or stored through OpenIntel is subject to strict handling requirements. Users must:
- Handle all personally identifiable information (PII) in accordance with applicable privacy laws
- Not store or cache sensitive data outside the platform's designated secure storage
- Report any suspected data breaches or unauthorized access immediately
- Follow data minimization principles - access only data necessary for the authorized purpose
- Comply with all data retention and destruction policies established by the Company and applicable law

6. Security Requirements
Users must maintain adequate security measures, including but not limited to:
- Using strong, unique passwords and enabling multi-factor authentication
- Keeping all client software and API integrations updated to the latest version
- Operating the platform only on secure, properly maintained systems
- Not accessing the platform from public or unsecured networks without VPN protection
- Reporting any security vulnerabilities discovered in the platform to the Company immediately
7. Compliance and Audit
The Company reserves the right to audit user activity to ensure compliance with this Agreement. All actions within the platform are logged and may be reviewed. Users consent to such monitoring as a condition of access.
You agree to cooperate with any audit or investigation initiated by the Company and to provide records of your use of the platform upon request.
8. Subscription and Payment
- Subscriptions are billed monthly or annually as selected during purchase
- All fees are non-refundable except as required by applicable law
- Annual subscriptions receive a 20% discount
- The Company may adjust pricing with 30 days' written notice
- Failure to pay may result in suspension or termination of access
9. Intellectual Property
All software, algorithms, models, interfaces, documentation, Decision Artifact formats, and related materials are the exclusive intellectual property of Detailed In Design, LLC. No license, right, or interest in any intellectual property is granted except the limited right to use the platform as authorized under this Agreement.
10. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE COMPANY SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM OR RELATED TO THE USE OF THE PLATFORM. THE COMPANY'S TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT PAID BY THE USER FOR ACCESS DURING THE TWELVE (12) MONTHS PRECEDING THE CLAIM.
OpenIntel provides intelligence and recommendations - not legal advice. Users are solely responsible for all decisions made based on information obtained through the platform.
11. Indemnification
Users agree to indemnify, defend, and hold harmless the Company, its officers, directors, employees, and agents from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from:
- Your violation of this Agreement or the Acceptable Use Policy
- Your misuse of the platform or data obtained through it
- Your violation of any applicable law or regulation
- Any third-party claim arising from your use of the platform
12. Disclaimer of Warranties
THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY. THE COMPANY DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, COMPLETENESS, AND NON-INFRINGEMENT.
13. Termination
The Company may suspend or terminate access at any time, with or without cause, and with or without notice. Grounds for immediate termination include:
- Any violation of this Agreement or the Acceptable Use Policy
- Any unlawful, unethical, or unauthorized use of the platform
- Failure to maintain required professional licenses
- Failure to pay subscription fees
- Any conduct that, in our sole judgment, may harm the Company, other users, or third parties
Upon termination, you must cease all use of the platform and destroy any data obtained through it, except as required by law or professional duty.
14. Governing Law
This Agreement shall be governed by and construed in accordance with the laws of the State of Illinois, without regard to conflict of law principles.
15. Arbitration
Any controversy or claim arising out of or relating to this Agreement shall be settled by binding arbitration administered by the American Arbitration Association under its Commercial Arbitration Rules in Cook County, Illinois. The arbitrator's decision shall be final and binding. Each party shall bear its own costs and attorneys' fees unless the arbitrator determines otherwise.
16. Modifications
The Company reserves the right to modify this Agreement at any time. Material changes will be communicated via email with at least 30 days' notice. Continued use of the platform after modifications constitutes acceptance of the updated terms.
17. Severability
If any provision of this Agreement is found to be unenforceable, the remaining provisions shall continue in full force and effect.
18. Entire Agreement
This Agreement, together with the Privacy Policy and Acceptable Use Policy, constitutes the entire agreement between the user and the Company regarding the use of OpenIntel and supersedes all prior agreements and understandings.
19. Survival
Sections relating to intellectual property, security safeguards, limitation of liability, indemnification, arbitration, lawful use, ethical requirements, and governing law shall survive termination of access.
